1. Acceptance and contract
By accepting a quote, selecting a plan, using a payment link, paying an invoice or asking us to begin work, you agree to these Terms, the Privacy Policy and the Refund & Cancellation Policy.
Your order confirmation, accepted quote or written scope forms part of the contract. If there is a conflict, the specific written scope takes priority, followed by these Terms.
2. Services and scope
Standard plans cover editing of footage supplied by the client. Filming, account management, paid media, posting and strategy are included only when expressly stated in writing.
Deliverables, formats, included revisions and monthly quantities are those shown in the selected plan or quote. Delivery estimates begin after payment and receipt of complete, usable files and instructions.
3. Client responsibilities
- Provide usable source files, accurate instructions and feedback within a reasonable time.
- Hold all necessary rights, licences and permissions for footage, logos, music, people, properties and other material supplied to PFRAME.
- Ensure supplied material and requested claims are lawful, accurate and do not infringe third-party rights.
- Keep independent copies of source files. PFRAME is not a permanent archive service.
4. Pricing and payment
Prices are shown in the stated currency. Any website currency conversion is indicative; the final amount, currency, taxes and recurring frequency displayed at Stripe Checkout or on the invoice control.
Work may be paused for overdue payment. The client remains responsible for approved work already completed and any non-cancellable third-party costs expressly authorised in advance.
5. Monthly subscriptions
Monthly plans renew automatically until cancelled. You may cancel before the next renewal date by the available billing portal or by emailing studio@pframevideo.com. Cancellation stops future renewals and does not normally create a prorated refund for the current billing period, subject always to mandatory consumer rights.
Unused monthly capacity does not automatically roll over unless the plan or a written agreement says otherwise. Client delays may move production into the next available delivery window.
6. Revisions and approval
Each plan includes the revisions stated in its description. Revision requests must relate to the agreed brief; a new concept, replacement footage or material scope change may require a new quote.
Please provide consolidated feedback within 7 calendar days of delivery. Silence may be treated as operational approval, but it does not remove any rights that cannot lawfully be excluded.
7. Intellectual property
You retain ownership of material you supply. Once all related fees are paid, ownership of the bespoke final deliverables transfers to you, excluding PFRAME’s pre-existing templates, workflows, know-how and third-party licensed assets.
Third-party music, fonts, stock assets and platform features remain subject to their own licence terms. PFRAME will not publish your work in its portfolio without permission.
8. Confidentiality and files
Each party must protect confidential business information received from the other and use it only to perform the project. This does not cover information already public, independently developed or required to be disclosed by law.
Unless another period is agreed, project uploads and working files may be deleted 90 days after final delivery. The client should download and back up final files promptly.
9. Results, availability and delays
PFRAME provides creative and editing services but does not guarantee views, followers, leads, sales or platform performance. Social platforms may change formats, policies or distribution without notice.
Neither party is responsible for delay caused by events reasonably outside its control. We will communicate material delays and propose a revised delivery plan.
10. Consumer guarantees and liability
Nothing in these Terms excludes, restricts or modifies the Australian Consumer Law or another right that cannot legally be excluded. Where permitted by law, remedies for a remediable service issue may include re-performing the affected service within a reasonable time.
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the contract was made. This limitation does not apply where prohibited by law, or to fraud, wilful misconduct or a breach of confidentiality.
11. Suspension and termination
PFRAME may refuse or suspend unlawful, unsafe, abusive, infringing or overdue work. Either party may terminate for a material breach that is not remedied within a reasonable written notice period.
On termination, amounts due for completed approved work remain payable. Refunds for unperformed services are handled under the Refund & Cancellation Policy and applicable law.
12. Governing law and disputes
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Mandatory rights available in the client’s location continue to apply where the law requires.
Before starting formal proceedings, both parties agree to attempt to resolve the issue in good faith by written notice. Consumers may also contact the relevant fair trading or consumer protection body.
13. Website use and changes
Website content is general information and may be updated. You must not misuse the site, interfere with its operation, attempt unauthorised access or copy PFRAME branding and content without permission.
Material changes to these Terms apply prospectively. The version accepted when an order is placed continues to govern that order unless both parties agree otherwise or the law requires a change.
